(1) Making a Contract with Something Divine

When you place an order with Something Divine, you are making an offer to purchase goods. We will send you an e-mail to confirm that we have received the order. The advertising of Products on the site constitutes an ‘Invitation to Treat' which means that your order is an offer, not a contract of sale between you and Something Divine.

Once we have checked the price and availability of the goods, we will e-mail you again to confirm that we accept your order, and that a contract has been made between us. We will not take payment from you until we have accepted your order.

In the unlikely event that the goods are no longer available, or that we have made a pricing mistake, or if we are unable to obtain authorisation for your payment, we will advise you of this. You will not receive an e-mail confirming your order, and there will be no contract between us.

(i) Refusal of Transaction

Something Divine reserves the right to withdraw any products or services from this website at any time and/or remove or edit any materials or content on this website. We reserve the right to refuse to process a transaction for products or services at any time at our sole discretion. We will not be liable to you or any third party by reason of our withdrawing any product or service from this website whether or not that product has been sold; removing or editing any materials or content on the website; refusing to process a transaction or unwinding or suspending any transaction process after processing has begun.

(2) How to place an Order with Something Divine

(i) After browsing the site, and familiarising yourself with the terms and conditions, click the ‘Buy Now' button on the product you wish to purchase. This will add the product to your shopping cart. You can return to the shopping area and add more products to your shopping cart if you wish. You have the opportunity within the shopping cart to further manage your order, by amending quantities, deleting products or adding gift-wrap and gift cards.

(ii) When your shopping cart is complete, click the ‘Checkout' button. If you are a new customer, you must then create an account with us and log in. If you are an existing customer, you must enter your login details.

(iii) Once you are logged in, you must select your preferred method of delivery, preferred delivery address, and confirm your Order and your consent to the terms of this Agreement.

(iv) You will be transferred to the Barclays secure website, and Barclays will handle your payment.

(v) We will then send you the First Acknowledgment in the form of an email thanking you for your order.

(vi) Once we have checked whether we are able to meet your Order, we will either send you the Second Acknowledgment in the form of an email accepting your order (at which point this Agreement will become a binding contract) or we will confirm by email that we are unable to meet your Order.

Please note that we will not file a copy of this Agreement. We may update the version of this Agreement on the Site from time to time, and we do not guarantee that the version you have agreed to will remain accessible. We therefore recommend that you download, print and retain a copy of this Agreement for your records.

(3) Delivery

Something Divine aims to pack and despatch your order to the address specified by you quickly and efficiently. Orders received before 2pm Monday to Friday will be despatched the same day. The delivery method used is based on the size, weight and value of the order.

(i) Delivery Charges

(a) Standard delivery: £4.00

Delivery: 1 - 3 days

Orders placed before 2pm Monday - Friday are despatched the same day via Royal Mail 1st Class or Parcel Force, subject to stock availability and security checks.

(b) Premium Delivery: £6.00

Delivery: Next Working Day Guaranteed

Orders placed before 2pm Monday - Friday are despatched the same day, for guaranteed next day delivery to a U.K. Mainland address via Royal Mail, subject to stock availability and security checks.

Certain UK addresses are subject to delays and exclusions. See Royal Mail table of exclusions .

On Fridays 'Next Day' means Monday. Deliveries are made Mon-Fri 8am - 6pm.

(c) Special Delivery: £10.00

Delivery: Next Working Day Guaranteed by 9am

When it simply won't wait, all orders placed before 2pm Monday - Friday are despatched the same day via Royal Mail subject to stock availability and security checks.

For orders placed on Fridays, this service will guarantee delivery on Saturday.

Certain UK addresses are subject to delays and exclusions. See Royal Mail table of exclusions.

(ii) Free Delivery Offers

Where a product states "Free Delivery" this means free standard delivery to mainland UK destinations, normally charged at £4.00. Free delivery applies to all UK mainland addresses except those specified in the Royal Mail table of exclusions.

(iii) Variation

Something Divine reserve the right to amend the delivery charges at any time and without notice.

(4) Risk and Title

The Products will be at your risk from the time of delivery. Ownership of the Products will only pass to you after we receive full payment of all sums due in respect of the Products (including delivery charges).

(5) Returns

(i) Returns Policy

At Something Divine, we want our clients to be completely satisfied with their purchases.

In the unlikely event that you are unhappy with your purchase, you can return items to us within 28 days of receipt of your order, and we will exchange or refund, providing that the goods are returned in perfect condition and in their original packaging.

If you receive an item that is defective, damaged, or not what you ordered, please notify us within 10 working days. Please either e-mail us at sales@somethingdivine.co.uk or call Customer Care on 0845 362 8567. Please have your order number to hand in order that we can try and resolve the issue quickly. There will normally be a representative available to assist you between 9.30am and 4.30 pm. Outside of these hours, or if all our representatives are engaged, please leave a message and we will call you back at the earliest opportunity.

For hygiene purposes, we cannot exchange or refund earrings.

Sale items may only be exchanged during the sale period.

Refunds, replacements or exchanges are normally processed within 7 working days of receipt of the item(s). Where appropriate, refunds will take the same method of payment as was used to make the original purchase. We will not refund any other services provided in connection with the purchase, such as gift wrapping. In the unlikely event of a problem with your refund, a member of our Customer Care team will contact you.

Please note, in all instances, Something Divine shall not be liable for incidental or consequential damages or expenses, including but not limited to lost profits or other economic or commercial losses. This warranty does not affect your statutory rights.

When returning an item, Something Divine strongly recommends that you send the package by Recorded or Special Delivery, and obtain a proof of postage as we cannot accept responsibility for items lost in transit.

(ii) Returns Procedure

Please download and print a Returns Note . If printing is not an option to you, please handwrite all of the information requested on the returns form in block capitals onto a piece of paper. Please make it clear whether you would like an exchange or a refund. Pack the item and return it to:

We will refund your postage in the case of faulty or wrong goods. In the case of ‘Change of Heart' you will be required to pay the cost of returning the item to us.

Where appropriate, a prompt refund will be issued if the item is in its original condition and all the relevant information on the returns note is complete. We reserve the right to withhold a percentage of the refund value of returned goods if the product or packaging is in such a condition that the product needs to be reduced in price for resale. The credit card used for the original purchase will be credited with the original purchase price and postage where appropriate. We will not refund any other services provided in connection with the purchase, such as gift wrapping. In the unlikely event of a problem with your refund, a member of our Customer Care team will contact you.

(iii) Returning a Gift

Something Divine are happy to exchange items received as gifts. If you are unsure what to exchange it for, we will happily issue a gift voucher to the value of the item being returned, which will be valid for 6 months. If a refund is required, it will be credited to the original purchaser.

This Agreement is made for the benefit of the parties to it and is not intended to benefit, or be enforceable by, any other person. The right of the parties to terminate, rescind, or agree any amendment, variation, waiver or settlement under this Agreement is not subject to the consent of any person who is not a party to this Agreement.

This Agreement contains the complete agreement between the parties with respect to the subject matter hereof, and supersedes all prior or contemporaneous agreements or understandings, whether oral or written.
